This Privacy Notice has been prepared under Article 10 of the Turkish Personal Data Protection Law No. 6698 (“KVKK”) to inform visitors of nuryapinsaat.com, people who fill in our forms and people who contact us about how their personal data is processed.

1. Data Controller

Your personal data is processed by NURYAP EMLAK VE GAYRİMENKUL PAZARLAMA İNŞAAT SANAYİ VE TİCARET LİMİTED ŞİRKETİ (“NURYAP”) as the data controller.

2. Personal Data We Process

  • Identity: first name, last name.
  • Contact: e-mail address, phone number, preferred contact channels.
  • Requests: the content of messages you send via the contact form.
  • Professional information (job applications): education level, position applied for, CV file and the information it contains.
  • Marketing: the e-mail address you provide to subscribe to our newsletter.
  • Transaction security: IP address, browser and device information, form submission time, spam and abuse prevention (Google reCAPTCHA) results.

Please do not include special categories of personal data (such as health, religion, union membership, criminal records or biometric data) in your application or CV. If such data is shared, it will not be considered and will be securely destroyed.

3. Purposes of Processing

  • Receiving and evaluating your contact requests and responding to you,
  • Receiving and evaluating job applications, contacting suitable candidates and carrying out recruitment processes,
  • Managing newsletter subscriptions and sending updates to subscribers,
  • Ensuring the security of the website and preventing spam, abuse and unauthorised access,
  • Providing website features (e.g. the map and country code detection in the phone field),
  • Fulfilling legal obligations and responding to requests from competent authorities.

4. Legal Grounds and Method of Collection

Your personal data is collected electronically, partly by automated means, through the contact, job application and newsletter forms on our website and through cookies and similar technologies. It is processed on the following legal grounds under Article 5 of the KVKK:

  • It is directly related to the conclusion or performance of a contract (Art. 5/2-c) — evaluating contact requests and job applications,
  • Compliance with a legal obligation of the data controller (Art. 5/2-ç),
  • The establishment, exercise or protection of a right (Art. 5/2-e),
  • The legitimate interest of the data controller, provided that it does not harm your fundamental rights and freedoms (Art. 5/2-f) — website security and abuse prevention,
  • Your explicit consent (Art. 5/1) — newsletter and non-essential cookies.

5. Transfer of Personal Data

Your personal data may be transferred, limited to the purposes above and in accordance with Articles 8 and 9 of the KVKK, to:

  • Competent public authorities and judicial bodies as required by law,
  • Service providers for website hosting, e-mail and IT services,
  • Service providers located abroad: Google LLC (reCAPTCHA spam protection, Google Maps, Google Fonts), Cloudflare, Inc. (content delivery and security) and ipinfo.io (country code detection in the phone field; only if you allow functional cookies). These transfers are carried out in accordance with the conditions set out in Article 9 of the KVKK.

6. Retention Periods

  • Contact form records: 2 years after the request is concluded,
  • Job applications and CVs: up to 1 year from the application date (if employed, as required by employment legislation),
  • Newsletter subscription: until you unsubscribe,
  • Security and access logs: for the periods required by applicable legislation.

Data whose retention period has expired is deleted, destroyed or anonymised in accordance with the applicable regulation.

7. Your Rights under Article 11 of the KVKK

By applying to NURYAP, you have the right to:

  • Learn whether your personal data is processed,
  • Request information if it has been processed,
  • Learn the purpose of processing and whether it is used accordingly,
  • Know the third parties to whom it is transferred in Turkey or abroad,
  • Request correction if it is incomplete or inaccurate,
  • Request deletion or destruction under the conditions of Article 7 of the KVKK,
  • Request that correction, deletion or destruction be notified to third parties to whom the data was transferred,
  • Object to a result against you arising from analysis exclusively by automated systems,
  • Claim compensation for damages arising from unlawful processing.

8. How to Apply

You can submit your requests in writing, together with information that identifies you, to Bostancı Mahallesi, Bağdat Caddesi, No: 448 Uras Apt. Kat: 2, Daire: 4, Kadıköy, İstanbul, Türkiye, or send them to [email protected] from the e-mail address registered with us or with a secure electronic or mobile signature. Your request will be concluded free of charge as soon as possible and within 30 days at the latest; if the process requires an additional cost, a fee may be charged in accordance with the tariff set by the Personal Data Protection Board.
